Challenge Rules

Eligibility

The "SmartCommute Challenge" (hereafter, the "Challenge") is open to all employees and college/university students within The Research Triangle Park, Durham County, Orange County, and Wake County, including full-time, part-time and contract employees, except where prohibited by law. Contestants must be 18 years or older. By entering the contest, participants certify that they meet the foregoing eligibility requirements. Members of the SmartCommute Challenge Committee and any immediate family members and/or persons living in the same household with the foregoing may participate in the Challenge, but are not eligible to win.

No purchase or expenditure is necessary to participate in the Challenge or win a prize. The Challenge is void where prohibited or restricted by law. Any person who satisfies the eligibility criteria above may participate by submitting a completed SmartCommute Challenge Pledge Form or by signing up on the website at www.SmartCommuteChallenge.org and by agreeing to try at least one alternate method of commuting during the SmartCommute Challenge, April 15 through May 30, 2008, or by completing the alternate mode of entry described below.

The Commitment Form is available in hard copy from participating employers, and as an online form on the website www.SmartCommuteChallenge.org.

The SmartCommute Commitment Form must be complete and accurate to be eligible and may be submitted via mail, via fax, or online at www.SmartCommuteChallenge.org.

Only one SmartCommute pledge per individual will be accepted. Additional entries submitted from the same individual in violation of this rule will be declared void. Personal information provided on the pledge form will only be used by SmartCommute@rtp and Triangle Transit and will not be given or released to outside organizations. Entries become the property of SmartCommute@rtp and Triangle Transit and will not be returned.

To enter without completing a pledge form or using the website, send a postcard with your name, employer, employer address, phone number, home zip code, and e-mail address to SmartCommute Challenge, Triangle Transit, P.O. Box 13787, Research Triangle Park, NC 27709.

All entries received by 11:59 PM EDT, May 30, 2008, will be entered into a random drawing for a SmartCommute Challenge Grand Prize. In addition, all entries received by 11:59 PM EDT, May 30, 2008, that do not win a Grand Prize will be entered into secondary random drawings based on the commute alternative mode indicated on pledge form for the remaining Challenge Prizes as listed on the website.

A total of two Grand Prizes and approximately five other prizes will be awarded, depending on the number of prizes donated by local employers and businesses. All entries submitted by employees working in The Research Triangle Park will be eligible for one Grand Prize, and all entries by other participants outside RTP will be eligible for the second grand prize. In addition, all entries received by 11:59 PM EDT, May 30, 2008, that do not win a Grand Prize will be entered into secondary random drawings based on the commute alternative mode indicated on pledge form for the remaining Challenge Prizes as listed on the website.

Prizes cannot be substituted or redeemed for cash. The odds of winning each prize will depend on the number of qualified entries.

Only the winners will be notified. SmartCommute organizers will use reasonable efforts to name winners by June 30, 2008 on the SmartCommute Challenge website, www.SmartCommuteChallenge.org. Winners will be identified by the name used on the pledge form or alternative mode of entry. If a winner cannot be reached through reasonable effort by June 30, 2008, SmartCommute@rtp and Triangle Transit reserves the right to declare that winner no longer eligible and to re-run the relevant drawing.

An entry in the Challenge shall constitute permission by the entrant for SmartCommute@trp and Triangle Transit to use a winning entrant’s name, photograph, company name, and all or part of the written description used to nominate the winner, without compensation, for business purposes, including but not limited to future Challenge promotions, in print, web, radio, television and other media, unless prohibited by law. Winners must agree to be photographed and videotaped and will have to sign a waiver to release their photographs and video to the SmartCommute Committee to be used in promoting future campaigns.

The SmartCommute Challenge Advisory Committee’s decisions on winners are final. SmartCommute@rtp and Triangle Transit reserve the right to modify the rules of the contest in any way, at any time, and to cancel the contest for any reason. It is the responsibility of each entrant to read and understand all information on the use, risks, and maintenance of any prize.

Prize winners are solely responsible to pay all federal, state, local, or other applicable taxes with respect to the prize awards. Because SmartCommute@rtp and Triangle Transit may be required to file certain information with various governmental agencies with respect to the prizes, the winner will be required to provide any and all information requested in connection with tax compliance and may be subject to applicable U.S. back-up withholding taxes. Failure to comply with a request for any such necessary information or comply with any U.S. or foreign tax or trade laws will result in forfeiture of the prize, or any claims to the prize.

By entering this promotion, each entrant accepts and agrees to be bound by these official rules and the decisions of the SmartCommute Advisory Committee, SmartCommute@rtp and Triangle Transit.

SmartCommute@rtp and Triangle Transit reserve the right to disqualify any entry determined to be the result of tampering with the SmartCommute Challenge system or in violation of these official rules.

SmartCommute@rtp and Triangle Transit and their agencies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Challenge or by any technical or human error that might occur in the processing of submissions in the Challenge.

SmartCommute@rtp and Triangle Transit and their agents assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.

SmartCommute@rtp and Triangle Transit and their agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Challenge.

If, for any reason, the Challenge is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of SmartCommute@rtp or Triangle Transit that corrupts or affects the administration, security, fairness, integrity or proper conduct of this Challenge, SmartCommute@rtp and Triangle Transit reserve the right to terminate the online portion of the promotion.

Free Vanpool Fare Give-away Rules and Restrictions

The Offer: If you start a new vanpool or join an existing one before May 30th, 2008, your first month’s fare will be sponsored by the SmartCommute Challenge.

Eligibility: To receive this free offer, if you join a new vanpool, your contract agreement must be signed by May 30th, 2008. Triangle Transit may not be able to put your vanpool on the road before May 30th. To receive this free offer, if you join an existing vanpool, you must ride the van before May 30th, 2008. For employees who work for a company that offers a subsidy for vanpool fares (See http://www.gotriangle.org/Bus/discountedPassPrograms.html for a list of companies that offer subsidies), this offer will cover the remainder of their first month’s fare and deposit after their employer’s subsidy has been taken.

Requirements for starting a new vanpool:

  • Your commute must be greater than 20 miles roundtrip.
  • Your trip must start or end in Wake, Durham or Orange County.
  • All van drivers and riders must be over 18.
  • For 12-15 passenger vans, you must have at least 10 riders and one qualified driver.
  • For 7-passenger vans, you must have 7 riders and one qualified driver.
  • Qualified drivers do not work for Triangle Transit. They are regular commuters. They must have clean driving records and good credit history, but do not need a CD-L or other special license.
  • Van drivers must have a safe off-the-street location to park their vans.
  • Van routes must be approved by Triangle Transit.
  • The vanpool driver must sign the Triangle Transit contract agreement.
  • Triangle Transit reserves the right to deny a vanpool to any group not meeting these requirements.

    Restrictions:
  • This offer is limited to 40 total vanpool fares valued at $85 or the cost to start service on four 15-passenger vans ($150 deposit and $700 average fare per van) or any combination thereof. The offer will not exceed $3,800.
  • Free fares will be given out on a first-come, first-served basis. For new vans, the first four vans to have signed contract agreements will receive the free month offer. For seats on existing vans, the first people to actually begin riding on their van will receive the offer.
  • In the event that more vans and new riders meet the eligibility requirements than the SmartCommute Challenge has the funds to cover, names will be drawn using a random number generator to select the offer recipients.

    Free Fare Value: The free fare offer includes a $150 security deposit and approximately $700 for your first month’s vanpool fare. Vanpool fares are based on the number of miles traveled by the van. The value of this offer will be greater for longer commutes. The vanpool fare includes insurance, maintenance, and gas costs.

Free Bus Fare Give-away Rules and Restrictions

The offer: Anyone who takes the SmartCommute Challenge and chooses to ride the bus to fulfill their pledge can register for ONE free Regional Day pass good on C-Tran, CAT, DATA or Triangle Transit.

Eligibility: To receive this free offer, you must live, work or go to school in Orange, Durham or Wake County and take the SmartCommute Challenge by pledging to ride the bus at least once before May 30th, 2008.

Restrictions:

  • This offer is limited to one per customer. Additional SmartCommute Challenge pledges and free bus fare requests by the same person will not be honored.
  • Tickets are non-transferable.
  • Tickets will not be refundable or redeemable for cash.
Free Fare Value: The free fare offer includes one Regional Day pass worth $4.
